This Privacy Notice for California residents (“California Privacy Notice”) supplements the information contained in Youth Enrichment Brands, LLC’s primary Privacy Policy. Youth Enrichment Brands, LLC (“we,” “us,” or “our”) has adopted this California Privacy Notice pursuant to the California Consumer Privacy Act, and its associated regulations (“CCPA”). Any terms defined in the CCPA have the same meaning when used in this California Privacy Notice.

This California Privacy Notice describes how we collect, use, and disclose Personal Information of California residents, including through interactions you may have with us online or outside of our website or mobile applications (collectively, our “Services”). If you work for us please see our California Employee Privacy Notice for applicable disclosures. California job applicants should refer to our California Applicant Notice.

Personal Information We Collect

“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. It does not include publicly available, deidentified, or aggregated information.

Within the past 12 months, we collected the following categories of Personal Information about California residents. Note that the Personal Information we collect about you may vary depending on the nature of your interactions with us, and may not include all of the examples listed below.

In addition to the purposes described above, we may use and disclose any category of Personal Information or Sensitive Personal Information we collect to respond to law enforcement requests, or as otherwise required or authorized by applicable law, court order, or governmental regulations; to protect our rights and interests and those of others (including our franchisees); to resolve any disputes; to enforce our terms and policies; and to evaluate or conduct a merger, sale, or other acquisition of some or all of our assets. We also reserve the right to use Personal Information we collect for any other purpose identified in an applicable privacy notice, click-through agreement, or other agreement between you and us, or otherwise with your consent.

We do not use or disclose Sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the CCPA.

How Long We Retain Personal Information

We keep the categories of Personal Information described above for as long as necessary for the purposes described in this Notice or otherwise authorized by law. This generally means holding the information for as long as one of the following apply:

·       Your Personal Information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the information;  

·       Your Personal Information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the Personal Information was collected;

·       The Personal Information is reasonably required to protect or defend our rights or property (which will generally relate to applicable laws that limit actions in a particular case); or

·       We are otherwise required or permitted to keep your Personal Information by applicable laws or regulations.

Where Personal Information is used for more than one purpose, we will retain it until the purpose with the latest period expires. For more information about our retention policies, please contact us using the contact details below.

How We Disclose, Share, and Sell Personal Information

We disclose Personal Information as shown below. The first chart shows the categories of Personal Information we disclose to our service providers and contractors for business or commercial purposes. Although we do not sell Personal Information in exchange for money, some of the ways in which we share Personal Information for advertising or disclose Personal Information to our franchisees or third-party business partners may be considered “sales” or “sharing” under California law.

The second chart shows the categories of Personal Information we share for purposes of cross-context behavioral advertising or otherwise “sell,” as that term is defined under California law. We do not sell or share the Personal Information of consumers under 16 years of age without affirmative authorization from a parent or guardian.

Sales and Sharing of Personal Information

Submitting Requests Relating to Your Personal Information

If you are a resident of California, you have the right to submit certain requests relating to your Personal Information as described below. To exercise any of these rights, please submit a request by calling us at 1 (877) 880-1957. Please note that, if you submit a request to know, request to delete, or request to correct, you will be asked to provide 2-3 pieces of Personal Information that we will match against our records to verify your identity. You may designate an authorized agent to make a request on your behalf; however, you will still need to verify your identity directly with us before your request can be processed. An authorized agent may submit a request on your behalf using the webform or toll-free number listed above.

Right to Know. You have the right to know what Personal Information we have collected about you, which includes:

(1)   The categories of Personal Information we have collected about you, including

a.     The categories of sources from which the Personal Information was collected

b.     Our business or commercial purposes for collecting, selling, or sharing Personal Information

c.     The categories of recipients to which we disclose Personal Information

d.     The categories of Personal Information that we sold, and for each category identified, the categories of third parties to which we sold that particular category of Personal Information

e.     The categories of Personal Information that we disclosed for a business purpose, and for each category identified, the categories of recipients to which we disclosed that particular category of Personal Information

Right to Delete Your Personal Information. You have the right to request that we delete Personal Information we collected from you, subject to certain exceptions. Where we use deidentification to satisfy a deletion request, we commit to maintaining and using the information in deidentified form and will not to attempt to reidentify the information.

Right to Correct Inaccurate Information. If you believe that Personal Information we maintain about you is inaccurate, you have the right to request that we correct that information.

Right to Opt-Out of Sales and Sharing of Personal Information. You may have the right to opt out of the sale of your Personal Information, and to request that we do not share your Personal Information for targeted or cross-context behavioral advertising. To opt-out, please click on “Do Not Sell/Share My Info” at the bottom of the relevant website. If you choose to use the Global Privacy Control (GPC) browser signal, you will only be opted out of online sales or sharing of Personal Information, and will need to turn it on for each browser you use.

Right to Non-Discrimination for the Exercise of Your Privacy Rights. If you choose to exercise any of your privacy rights under the CCPA, you also have the right not to receive discriminatory treatment by us.

Personal Information of Minors

We “sell,” as the term is defined in the CCPA, Personal Information to the Title Sponsor of a camp (or other activity) when we share camp participants’ Personal Information with the Title Sponsor. Pursuant to an agreement with the Title Sponsor, we disclose the email addresses of the parent or guardian provided with each camper’s registration, and we also may disclose additional Personal Information (including the camp participant’s Personal Information) included in the registration, but only with the express consent of the parent or guardian who submits the camper registration. We may also provide a camp participant’s Personal Information (included in a camper’s registration during the registration process) to a third-party partner when a parent or guardian requests that such information be shared with such third-party partner. We do not knowingly sell the Personal Information of minors under the age of 18, without express consent from a parent or guardian. Prior to accepting a camper registration, we verify the age of the person submitting the registration based on their date of birth.

Third-Party Marketing Rights

California Civil Code Section 1798.83 permits California customers to request certain information regarding our disclosure of personal information (as defined separately from the CCPA and used throughout this California Privacy Notice) to third parties for their direct marketing purposes. To make such a request, please send an email to privacy@yeb.com with the subject “Shine the Light Request.”

Changes to Our California Privacy Notice

Youth Enrichment Brands, LLC reserves the right to amend this California Privacy Notice at our discretion and at any time. When we make changes to this California Privacy Notice, we will post an updated version on our website with the effective date.
